This may reflect parents’ greater disaffection with large, impersonal high schools, relative to their neighborhood elementary schools. We must be careful not to generalize from these bad apples. Yet they crisply illustrate how the rhetoric behind “direct market accountability” gives way to tolerance of entrepreneurs and well-meaning charter directors who are really not held to account for whether their students are learning effectively. In the absence of careful accountability and regulation—as in health care or child care—we should expect to see rip-offs and ineffective schools. A second conception of the political charter involves the broader political legitimacy of the charter school institution.
By fall 2000, more than 1,600 schools were operating nationwide. State legislation varies in how much rope is given to charter schools, and whether this line can be pulled by a transparent public authority that reviews the effectiveness of each school. States also expect varying levels of accountability. For example, Arizona law grants a charter for fifteen years, requiring a review by the state board of education every five years. In Florida, charter schools can gain a license to operate for three years before they are formally reviewed.
