Christoph Möllers (in Chapter 8) ventures into two of the different constitutional traditions of Europe: the revolutionary French-American way and the German-British evolutionary constitution-making. In the latter type, the constitution emerges from conventional sources and takes the role of power-shaping juridification of politics —from above. The former sees the constitution as a clear break with the past and it therefore must develop its own set of justifications. It relies on a clear theory of popular sovereignty and democratic legitimacy for this, whereas the latter sees the constitution in evolutionary terms, and as a means of constraining already established state power.
